procedures and incompatibilities :
The judges of the Central African Council of State are appointed
by decree of the President of the Republic with the advice of the
consultative Commission of the Council of State. The quality of
member of the Council of State is incompatible with any paid activity
and with any elective or governmental activity.
Internal
organization :
The Council of State is made up of two sections, the administrative
section and the section of litigations.
The last one is subdivided into two sub-sections.

The Council only started effectively its activities in 1997.

functions
Jurisdiction
:
The administrative section prepares the advices the Council of State
is asked for.
The section of litigations adjudicates the disputes which are submitted
to it.
Organization of the courts system :
The Council of State is at the top of a judicial system which
includes :
- the administrative tribunals ;
- the administrative jurisdictions which rule in last resort, especially
the audit office.
Powers of
the judge (annulment, reversal, compensation... ) :
The administrative judges are independent and are only submitted
to the law. They are answerable to nobody. They work to the best
of their knowledge and belief.

Advisory
functions
The Council
of State gives its advice on the governmental and parliamentary
bills and drafts of decrees. These texts can be submitted to the
Council by the President of the Republic or the President of the
National Assembly.It also gives its opinion if it is requested by
the same authorities mentioned above about any legal or administrative
question. The Council of State can, on its own initiative, draw
the attention of the President of the Republic or the President
of the National Assembly on reforms of primary and subordinate legislation
for which it is competent.
Miscellaneous
remarks
The Central
African Council of State is a new administrative jurisdiction created
by the Constitution of 14th January 1995 and which has only been
established in 1996. It is operational since 1997.
