Composition
and structure

members :
Nine including the President.
Recruitment
procedures and incompatibilities :
The magistrates
of the Supreme Court, which is the Republic's highest ordinary jurisdiction,
are recruited among the magistrates with the most seniority and
experience. They are appointed by a decree of the President of the
Republic upon a proposition of the Minister of Justice.
The function
of magistrate at the Supreme Court are incompatible with any administrative
function or with any profession, exercised either by the magistrate
himself, or his spouse, or a person acting in his name, and which
could harm the accomplishment of the duties related to the magistrate's
function. Any mandate or duty in private profit-making business,
even if it is not paid, is not compatible, except if the mandate
is exercised in the name of the State.
Internal
organization :
The Supreme Court is organized into three Chambers :

the
Chamber of cassation which reviews judicial decisions pronounced
in second instance; |
 |
the
Administrative Chamber which is competent to rule the appeals
against the judgments of the administrative jurisdictions and
against the decisions taken by some administrative authorities
; |
 |
the
Judicial Chamber which judges the violations of the law by political
representatives or any person justiciable before the Supreme
Court in the first and last instance. |
The Constitutional Chamber has been erected into a Constitutional
Court since the new Constitution promulgated on March 13th 1992.

Court
functions
Organization
of the courts system :
The united Chambers of the Supreme Court sit as judge of cassation
for the rulings of the judicial chamber or any other chamber of
the Supreme Court, or for the rulings of Courts having the same
rank as the Supreme Court, such as the Audit Office, which rules
the penal cases or the cases related to the justification of the
origins of goods of officials or public mandatories.
The Supreme
Court and the Constitutional Court together constitute the High
Court of Justice which is competent to judge the President of the
Republic in case of high treason and the Prime Minister and the
President of the National Assembly for crimes and offences committed
during their mandates.
